Namasthe India Privacy Policy

Namasthe India ("we", "us", or "our") respects your privacy.   • Payment-related information processed by our payment providers. We do not intentionally store full payment card numbers.

  • Communications, including emails, SMS messages, call records, voicemails, reviews, feedback, and support messages.
  • Geolocation information if you permit location features or if location is inferred from your IP address for delivery, store finder, fraud prevention, or analytics.

2. Sources of Information

We collect information directly from you, through our website and applications, from Tilvo as our technology provider, from payment processors, delivery providers, POS systems, loyalty and messaging providers, communications providers including Telnyx where enabled, advertising and analytics partners, social media platforms, and from public or commercially available sources.

3. How We Use Information

  • To accept, prepare, fulfill, deliver, refund, and support orders, reservations, catering requests, gift cards, and loyalty activity.
  • To create and maintain customer accounts, remember preferences, and personalize the guest experience.
  • To communicate about transactions, account activity, support requests, operational updates, and marketing where permitted.
  • To improve menus, service quality, website performance, restaurant operations, fraud prevention, and security.
  • To conduct analytics, advertising, promotions, surveys, and customer retention campaigns.
  • To comply with legal obligations, enforce our terms, resolve disputes, and protect our rights and the rights of others.

4. Cookies, Analytics, and Advertising

We and our service providers may use cookies, pixels, SDKs, local storage, and similar technologies for site functionality, cart/session management, analytics, measurement, personalization, advertising, and fraud prevention. 5. SMS, Calls, and Marketing Communications

Message and data rates may apply. SMS, MMS, voice, phone number, and call-routing services may be delivered through communications providers such as Twilio or Telnyx. Reply STOP to opt out and HELP for help. Consent is not required as a condition of purchase. We do not sell or share mobile opt-in data or SMS consent with third parties for their own marketing.

6. How We Disclose Information

We may disclose information to:

  • Tilvo, POS providers, hosting providers, analytics providers, messaging and telecom providers including Telnyx where enabled, loyalty vendors, payment processors, delivery/logistics providers, and other service providers that help operate our business.
  • Delivery drivers, catering partners, event partners, or fulfillment participants as needed to complete your request.
  • Advertising and analytics partners for measurement, attribution, and targeted advertising where permitted by law.
  • Professional advisors, insurers, regulators, law enforcement, courts, or other parties when required or permitted by law.
  • Successors in connection with a merger, financing, sale, bankruptcy, reorganization, or transfer of all or part of our business.

7. State Privacy Rights

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of personal information; opt out of certain targeted advertising, sales, or sharing; limit certain sensitive information uses; and appeal a denied request. Namasthe India Terms

These Terms apply when you access localhost, order from Namasthe India, use our customer account features, participate in promotions or loyalty programs, or otherwise purchase products or services from us. By using our services, you agree to these Terms and our Privacy Policy.

1. Restaurant Responsibility

Namasthe India is responsible for restaurant operations, menu descriptions, pricing, food preparation, allergen handling, pickup, delivery arranged by the restaurant, refunds offered by the restaurant, gift cards, promotions, and customer service. Tilvo provides technology that powers portions of the website, ordering, loyalty, messaging, and related guest experiences.

2. Accounts and Information

You agree to provide accurate information and to keep account credentials secure. You are responsible for activity under your account unless caused by our failure to use reasonable security measures.

3. Orders, Availability, and Pricing

Menu items, availability, descriptions, fees, taxes, discounts, delivery areas, and prices may change without notice. An order is not accepted until confirmed. We may cancel, decline, or modify orders because of item availability, operational limits, suspected fraud, incorrect pricing, weather, safety concerns, or other reasonable restaurant needs.

4. Pickup, Delivery, Catering, and Alcohol

Estimated pickup and delivery times are estimates only. You are responsible for providing accurate contact and delivery information and being available to receive your order. Catering and event orders may be subject to separate timing, deposit, minimum spend, cancellation, and service terms. If alcohol or age-restricted products are offered, you must satisfy all legal age and identification requirements, and service may be refused where required or appropriate.

5. Payments, Tips, Fees, Refunds, and Chargebacks

You authorize the applicable payment processor to charge the selected payment method for orders, taxes, tips, delivery fees, service fees, and other disclosed charges. Refunds, credits, replacements, and cancellations are handled at the restaurant's discretion unless otherwise required by law. If you dispute a valid charge, we may suspend account features or require a different payment method for future orders.

6. Loyalty, Rewards, Gift Cards, and Promotions

Rewards, points, coupons, gift cards, referral offers, and promotions may have eligibility rules, expiration dates, exclusions, and limits. They have no cash value unless required by law, may not be transferred or resold, and may be modified or discontinued where permitted.

7. Acceptable Use

You may not misuse the site, interfere with security, attempt unauthorized access, scrape data, submit false or misleading information, abuse promotions, harass staff or guests, infringe rights, or use our services for unlawful purposes.

8. Third-Party Services

Our site may use third-party payment, delivery, map, analytics, POS, loyalty, messaging, telecom, or authentication providers, including Telnyx for certain SMS/MMS, voice, SIP trunking, phone number, and call-routing functions where enabled. Those providers may have their own terms and privacy notices. We are not responsible for third-party services outside our control.

9. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, our services are provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or service unavailability.
